Acceptance of the General Terms and Conditions

1. During the registration or purchase (in both cases), if the user wishes to use the services of the Webshop, he or she shall accept the terms and conditions of these GTC, which the user can do by selecting the check box on the form. In the case of accepting the terms and conditions of the GTC, a contract according to these General Terms and Conditions is concluded between the Service Provider and the user of the Webshop.
2. If the user does not accept the terms of the General Terms and Conditions, he or she may not use the services of the Webshop. The user cannot register, and cannot place any orders.

Please read these Terms of Service carefully before accessing or using our website. By accessing or using any part of the site, you agree to be bound by these Terms of Service. If you do not agree to all the terms and conditions of this agreement, then you may not access the website or use any Services. If these Terms of Service are considered an offer, acceptance is expressly limited to these Terms of Service.

Any new features or tools which are added to the current store shall also be subject to the Terms of Service. You can review the most current version of the Terms of Service at any time on this page. We reserve the right to update, change or replace any part of these Terms of Service by posting updates and/or changes to our website. It is your responsibility to check this page periodically for changes. Your continued use of or access to the website following the posting of any changes constitutes acceptance of those changes.

By ordering a product, you agree to be legally bound by these Terms and Conditions. Please ensure you have read and understood them before placing an order.

In the unlikely circumstance that Ciani Lingerie cannot fulfil your order for any reason, an email will be sent promptly to the email address provided at the time of ordering, explaining the situation and all possible solutions.

Please check the contents of your cart and your delivery information to ensure your order is correct before pressing ‘Pay Now’, as Lounge Underwear Limited may be unable to amend or cancel your order once submitted. If you have entered any incorrect information at checkout, please contact a member of the team at your earliest convenience, but please be aware that order cancellations or amendments may not be possible.

Ciani Lingerie reserves the right to reject or cancel the fulfilment of any and all orders placed on the Site. We explicitly reserve the right to not accept your order for any of the following reasons:

• The product is not available (‘out of stock’).
• Your billing information is not correct or not verifiable.
• Your order has been suspected of fraudulent activity.
• Our couriers were unable to deliver to the shipping address provided at checkout.
• Force Majeure.
• In the event of misspelling, errors in pricing or other errors in the information provided on the Site.

The conclusion of the Sales Contract:

1. If the user places an order on the pages of the Webshop, and the Service Provider confirms the order by e-mail, a sales contract is concluded between the customer (user) and the Service Provider. (If the e-mail confirming the arrival of the order is not received by the customer within 48 hours form placing thereof, the customer is released from the obligation of the offer, and is not obliged to purchase the ordered product(s) or use the service.)
2. The user shall accept that the contract concluded in this way is considered to be concluded in writing, and it is governed by the Hungarian Law and regulations. The contract is subject to the provisions of these GTC.
3. The contract is concluded in Hungarian, and it is stored automatically by the Webshop in electronic form. It is available to the user after logging into the Webshop. The contents thereof can be read, and the contract itself can be saved or printed, as well.

Prices

The prices published in the Webshop are gross prices with VAT added, which include the price of the products and excluding specific shipping costs.

Shipping rates are applied per order. The exact shipping rate applied to your order will depend on the delivery location.

There are various payment methods available to you which will be displayed during the checkout process. Please be aware that we do not accept cash, cheques or Afterpay.

All payments are subject to validation checks and authorisation by your chosen payment service provider. If the provider refuses to, or cannot for any reason, authorise payment, you will be notified by email during the checkout process.

Conversion rates may apply to prices across destination-specific stores on the Site.

Ciani Lingerie reserves the right to change the price of a product at any time, without warning. Any orders placed prior to this change cannot be amended to the revised price.

Delivery, personal receipt

1. Delivery deadlines can be found on the product presentation pages.
2. Product delivery is done by the Service Provider at the time agreed with the customer.
3. The customer is obliged to check the integrity of the package at the time of delivery. In the case of damaged packaging, the defect shall be recorded on site in a protocol. 

Delivery is carried out globally by the courier company FedEx.

All orders made on the Site are dispatched from the EU. We aim to dispatch all orders on the day the order is placed; however, due to demand, this is not always possible. A tracking number, if applicable, will be included in your shipping confirmation email, which you will receive a short while after you receive your order confirmation email.

Depending on the delivery address provided by the Customer, there will be various delivery options available. The shipping fee will depend on the delivery option you select. All available shipping methods will be displayed to you during the checkout process.

Ciani Lingerie cannot be held accountable for parcels delayed for reasons beyond our control. These reasons include but are not limited to the following: customs, service strikes, civil commotion, riot, invasion, terrorist attack or threat of terrorist attack, weather, natural disasters, fire, epidemics or failure of public or private telecommunications networks.

Our couriers do not carry out deliveries during weekends or public holidays.

Countries outside of the European Union may be subject to additional duties to be paid. As the recipient, you are liable for all import duties, customs and local sales taxes levied by your country of residence; payment is necessary to release your order from customs.

If you refuse to pay the duties to release your order, your order may be abandoned by the courier and made non-refundable. Lounge Underwear Limited will make every reasonable effort to ensure the parcel can be shipped back to the warehouse and refunded. Shipping and handling fees may, in this case, be applied to the Customer.

Method of reporting a warranty or guarantee claim

Notification in writing

The customer may notify the Service Provider of a warranty or guarantee claim in e-mail or by phone, via WhatsApp or Instagram.

The letter of complaint (message) shall contain: 

– the name and address of the customer,
– the name of the product and the purchase price,
– the date of purchase,
– the date of notification of the defect,
– the description of the defect,
– the claim the customer wishes to assert.

Modifications to the Service and Prices

Prices for our products are subject to change without notice.
We reserve the right at any time to modify or discontinue the Service (or any part or content thereof) without notice at any time.

Certain products or Services may be available exclusively online through the website. These products or Services may have limited quantities and are subject to return or exchange only according to our Refund Policy.

We reserve the right, but are not obligated, to limit the sales of our products or Services to any person, geographic region or jurisdiction. We may exercise this right on a case-by-case basis. We reserve the right to limit the quantities of any products or Services that we offer. All descriptions of products or product pricing are subject to change at anytime without notice, at the sole discretion of us. We reserve the right to discontinue any product at any time.

Out of Stock Item

In the event an item ordered is unavailable, we will issue a refund for this item. Due to the influx of orders that we experience, we will be unable to notify you before the refund has been issued and the remaining items of the order have been shipped. Thank you for your understanding of this matter.
